  • Seventh Circuit OKs compensation to Ponzi victims factoring in their withdrawals

RDAP partner Kevin Duff was the recent recipient of a favorable ruling in the United States Court of Appeals for the Seventh Circuit, arising from his role as the Court-appointed Receiver for a Ponzi scheme operator.  In Huber v. SEC, 702 F.3d, 903 (7th Cir. Nov. 29, 2012), the court recently affirmed a district court order approving a distribution plan based on a 'rising tide' methodology that Duff had recommended. RDAP served as counsel for Duff in both the District and appellate courts.  As described in this article from the National Law Journal, the decision by Judge Posner included a detailed analysis of the economic bases for upholding the appropriateness of the distribution plan recommended by Duff.

  • The Ongoing Fight For Prentice and Process

RDAP Partner Michael Rachlis is one of the attorneys representing Landmarks Illinois and the National Trust for Historic Preservation in their ongoing litigation to prevent demolition of Prentice Womens Hospital, the landmark building designed by architect Bertrand Goldberg on Northwestern University's lakefront campus.  The dispute is currently in litigation in the Circuit Court of Cook County, Illinois, which has imposed an emergency stay preserving the status quo regarding Prentice, and leaving in effect the Landmark Commission's preliminary landmark determination.  This lawsuit is just the most recent of Mr. Rachlis’s role as litigation counsel on land use issues generally, and here in support of preservation of architecturally and historically significant landmarks.  A host or recent articles detail the battle for Prentice and Mr. Rachlis’s role, including these articles from the websites of WBEZ and Crain’s Chicago Business.
