Mr. Durham's
experience includes defense of a national engineering firm against
a multi-million dollar lost profits claim arising from the design
and construction of semi-conductor manufacturing plant; defense
of the same national engineering firm against a multi-million dollar
lost profits claim arising from the design and construction of a
prototype devise for the treatment of mixed radioactive and hazardous
waste; defense of a design-builder and general contractor against
a multi-million design defect and delay claim brought by a structural
steel subcontractor; representation of another national firm against
a multi-million dollar design defect claim arising from the construction
of an anaerobic wastewater pretreatment system; and negotiation
of a performance bond take over agreement on behalf of an owner
and general contractor. In the past Mr. Durham has litigated suits
involving breach of contract, breach of fiduciary duty, federal
and state environmental claims, interference with contract and prospective
advantage, age and disability discrimination, Civil RICO, Lanham
Act trademark infringement and lender liability claims.
Mr. Durham
has successfully argued appeals before the Seventh and Eighth Circuit
Courts of Appeals of the United States. Mr. Durham has also successfully
tried cases in both Federal and Illinois State Courts.
